Hotel alleges negligent battery install caused fire

NEW ORLEANS – A hotel and its insurer allege they had to pay for damages as a result of a fire caused by negligent work.

RIJ III- St. Charles Ave Hotel LLC and Chubb Custom Insurance Co. as subrogee of RIJ III-St. Charles Ave Hotel LLC filed a suit against Cybertronic Coatings LLC and SimplexGrinnell LP in the Orleans Parish Civil District Court on Sept. 20.

According to the claim, the defendants replaced a battery in the fire pump engine for the fire suppression system at the Hotel Indigo New Orleans Garden District in March 2015. The suit states that during a test of the system in September 2015, a small fire started that was a result of an electrical short in the system. The plaintiffs allege they had to pay to replace several parts in the system because of the defendants' negligent battery install causing the fire.

The defendants are accused of negligence through failing to exercise the reasonable degree of care.

The plaintiffs are seeking an unspecified amount in damages. They are represented by Robert R. Johnston, Lawrence R. Demarcay III and Fowler Rodriguez of New Orleans.

The case has been assigned to Division M Judge Paulette R. Irons.
