Driver files suit over alleged injures in tractor-trailer accident on I-12

NEW ORLEANS – A tractor-trailer operator is suing another driver for alleged damages after an accident on Interstate 12 in St. Tammany Parish.

Harry M. McKinley filed a complaint on Sept. 7 in the U.S. District Court for the Eastern District of Louisiana against the Mark E. Tomlinson, Bynum Transport Inc. and Westfield Insurance Co. alleging negligence.

According to the complaint, the plaintiff alleges that in Oct. 14, 2015, he was driving a tractor-trailer on I-12 when Tomlinson, also driving a tractor-trailer for Bynum Transport, rear-ended his truck, which resulted in a complete loss of his tractor and injuries to his person. His injuries caused him to need medical care and treatment and suffer pain, mental anguish and lost wages. The plaintiff holds Tomlinson, Bynum Transport Inc. and Westfield Insurance Co. responsible because Tomlinson allegedly failed to obey traffic signal, failed to keep proper lookout and failed to timely apply brakes.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount that will fully compensate him for his damages, plus interest and for all equitable relief that he may be entitled.
