Whitney Bank claims couple defaulted on promissory note

BATON ROUGE — A Mississippi state chartered bank is suing Robert E. Brooks and Lynda K. Brooks, a married couple living in New Orleans, citing alleged breach of contract.

Whitney Bank filed a complaint on Sept. 13, in the U.S. District Court for the Middle District of Louisiana against the defendants, alleging that they failed to comply with a document referred to as the Delphi Promissory Note.

According to the complaint, the plaintiff alleges that as of the date of filing the complaint, all of the indebtedness of the makers and guarantors on the Delphi Promissory Note remain in default in the principal amount of $3,799,300.35 plus interest and late charges. The plaintiff holds Robert E. Brooks and Lynda K. Brooks responsible because the defendants allegedly failed to make full payment of all the sums due and owing pursuant to their guaranty agreement.

The plaintiff requests a trial by jury and seeks judgment against the defendants, jointly and severally, in the principal amount of 3,799,300.35, plus interest of $867,151.68 and late charges of $5,000, attorney fees, costs and expenses and for such other relief as the court deems just. It is represented by Joseph P. Hebert and William E. Kellner of Liskow & Lewis in Lafayette.
