Delivery driver alleges he was injured while delivering refrigerator

NEW ORLEANS – A delivery driver alleges he was terminated for performing a job in violation of company policy despite being instructed to do so.

Larry Mitchell filed a suit against Fright Rite Inc., Scott Louy, individually and doing business as Freight Rite Inc, Brian Beebower, individually and doing business as Freight Rite Inc. and ABC insurance Co. in the Orleans Parish Civil District Court.

According to the claim, on Jan. 15, 2015, the plaintiff was given instructions to deliver a refrigerator and lift it over a balcony. He alleges these instructions are against company policy but followed them because he was afraid he would be terminated if he did not. The suit states he was injured in performing the instructions, and was terminated on Jan. 19, 2015, for violating company policy.

The plaintiff is seeking an unspecified amount in damages. He is represented by J. Nelson Mayer III of Valteau, Harris, Koenig & Mayer of New Orleans.

The case has been assigned to Division J Judge Paula A. Brown.
