Ouachita Parish resident accuses Northern Louisiana Medical Center of negligence

MONROE — A Ouachita Parish resident is suing Ruston Louisiana Hospital Co. LLC d/b/a Northern Louisiana Medical Center, a health care provider, citing alleged insufficient measures were taken to prevent injuries from a malfunctioning elevator.

Taurus Davis filed a complaint in the U.S. District Court for the Western District of Louisiana against Ruston Louisiana Hospital Company LLC d/b/a Northern Louisiana Medical Center alleging that the health care provider breached its duty owed to its guest to properly maintain the elevators.

According to the complaint, the plaintiff alleges that, on Aug. 26, 2015, he was a guest at defendant Northern Louisiana Medical Center when the elevator door malfunctioned and repeatedly struck his body, causing him serious injuries that necessitated medical care and treatment. Said injuries caused him to suffer loss of earning capacity, mental anguish, disability and inconvenience. The plaintiff holds Ruston Louisiana Hospital Co. LLC d/b/a Northern Louisiana Medical Center responsible because the defendant allegedly created and allowed the hazardous condition to exists, negligently maintained the elevator and failed to warn patrons of the known hazards and defects.

The plaintiff requests a trial by jury and seeks judgment against defendant, with legal interests and for all cost of these proceedings. He is represented by Mark W. Smith of Mark W. Smith & Associates APLC in Metairie.
