Randy Mosele filed a complaint on behalf of all others similarly situated in the U.S. District Court for the Eastern District of Louisiana against ITT Educational Services, Inc. alleging that the higher education institution violated the provisions of Worker Adjustment and Retraining Notification Act.
According to the complaint, the plaintiff alleges that he suffered damages in the amount equal to his 60 days’ pay and benefits and was terminated as part of defendant's mass layoff and/or plant closings. The plaintiff holds ITT Educational Services, Inc. responsible because the defendant allegedly concealed that its two branch campuses in Baton Rouge and in St. Rose was permanently closing and did not give him the statutorily required 60 day notice of the mass layoff or termination.
The plaintiff requests a trial by jury and seeks judgment against defendant for all damages, an order certifying this case as a class action and appointing plaintiff and his counsel to be class representatives, attorneys’ fees and costs, pre- and post-judgment interest and for such other additional relief.
