Woman claims attorney pushed her when trying to collect W-2

GRETNA – A teacher alleges she was pushed and injured by her former employer's attorney when she was trying to collect a form.

Athena Simmons filed a suit against Gerald Cooper, St. Paul Lutheran School and XYZ insurance company in the 24th Judicial District Court on Oct. 19.

According to the claim, the plaintiff alleges a W-2 form was sent to the Internal Revenue Service following her end of employment with St. Paul Lutheran School in 2012 with the incorrect information. The suit states that despite her faithfulness in attempting to file the right form, she was told to go directly to Cooper, an attorney, to collect the form. The suit states the plaintiff went to Cooper's office on Oct. 13, 2015, where he pushed the plaintiff, causing her to suffer a torn rotator cuff.

The defendants are accused of negligence.

The plaintiff is seeking an unspecified amount in damages. She is representing herself.

The case has been assigned to Division P Judge Lee V. Faulkner.
