Planet Beach Brands alleges photo of Hotworx system was used without permission

NEW ORLEANS – A Marrero company alleges a dissolved company and two Florida residents used photos of its sauna system in a brochure without permission.

Planet Beach Brands filed a complaint on Oct. 7 in the U.S. District Court for the Eastern District of Louisiana against LuxSauna Inc., David Floyd Shurtleff and William Eucker alleging copyright infringement.

According to the complaint, the plaintiff alleges that it has sustained and continues to sustain substantial irreparable injuries, unless and until defendants are enjoined and restrained from continuing their infringing activities. The plaintiff holds LuxSauna Inc., Shurtleff and Eucker responsible because the defendants allegedly reproduced and displayed publicly plaintiff's copyrighted photograph of Hotworx infrared suana unit without authorization in a brochure.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly, severally and in solido, for actual damages, statutory damages up to $150,000 per copyrighted work infringed, enjoining them from reproducing and displaying plaintiff’s photograph, costs for this action and all other equitable relief. It is represented by William W. Sentell III and Lawrence G. Pugh of Pugh, Accardo, Haas, Radecker & Carey LLC in New Orleans.
