Men allege railcar overloaded with chemical caused injuries

NEW ORLEANS – Two railroad switchmen allege that an overloaded railcar caused them injures.

Brad Boyd and Johnny Reyes filed a complaint on Oct. 18 in the U.S. District Court for the Eastern District of Louisiana against SGS North America Inc. alleging negligence.

According to the complaint, the plaintiffs allege that on June 7 they experienced extreme discomfort, burning, and irritation in their eyes and on their eyelids when they were exposed to chemicals leaking from a rail car at the Dow Chemical Plant in Hahnville. They allege they suffered physical and mental pain, disability, lost wages and benefits and medical expenses.

The plaintiffs holds SGS North America Inc. responsible because the defendant allegedly failed to exercise reasonable care in properly loading and securing the subject tank car and failed to take corrective action or to warn train crews of the risk of exposure to the chemicals.

The plaintiffs request a trial by jury and seek judgment against defendant for all sums reasonable in the premises, plus interest, all costs of these proceedings and for all general and equitable relief. They are represented by Joseph M. Miller, Benjamin B. Saunders and Carisa German-Ogden of Davis, Saunders, Miller & Oden in Mandeville.
