NEW ORLEANS — A truck driver is suing Safeway Insurance Co., Steadfast Insurance Co., Red Rock Risk Retention Group Inc. and Nick Daniel Capdeboscq, underinsured motorist and insurance providers, citing alleged insufficient measures were taken to prevent injuries.
Louis Basilone filed a complaint in the U.S. District Court for the Eastern District of Louisiana against the defendants alleging that defendant Capdeboscq failed to operate his motor vehicle in a lawful and prudent manner.
According to the complaint, the plaintiff alleges that, on Nov. 4, 2015, he was on a bicycle trip to the laundromat in Tangipahoa Parish to do his laundry when defendant Capdeboscq struck him and his bicycle from behind that caused him to suffer life-threatening injuries and medical bills exceeding $300,000. The plaintiff holds Safeway Insurance Co., Steadfast Insurance Co., Red Rock Risk Retention Group Inc. and Nick Daniel Capdeboscq responsible because defendant Capdeboscq allegedly negligently looked away from the roadway in order to adjust his AC unit and failed to pay attention to the road in front of him.
The plaintiff requests a trial by jury and seeks judgment against the defendants in the amount of $2.6 million, plus interest, costs and all equitable relief as the court may grant. He is represented by J. Price McNamara of the Law Offices of J. Price McNamara in Baton Rouge.
