Ashley Madison user files suit after site's data breach

NEW ORLEANS – An Ashley Madison user is seeking damages after the site's 2015 data breach.

Keith Plaisance filed a complaint on Nov. 4 in the U.S. District Court for the Eastern District of Louisiana against Avid Life Media Inc. and Avid Dating Life Inc., doing business as Ashley Madison, alleging that they violated the Federal Stored Communications Act, breach of contract, negligence and other counts.

According to the complaint, the plaintiff alleges that in 2007, he created an account with defendants' AshleyMadison.com. On Aug. 21, 2015, a data breach with the website made his information public, the suit states. He alleges he was not in a relationship at the time he made an account but was married when the information was leaked, and as a result his wife filed for divorce on March 10.

The plaintiff holds Avid Life Media Inc. and Avid Dating Life Inc. responsible because the defendants allegedly failed to protect their members' personal and financial information.

The plaintiff requests a trial by jury and seeks compensation for damages in an amount to be determined at trial, plus interest, attorneys' fees and costs and any further relief as the court deems just. He is represented by Scott R. Bickford, Lawrence J. Centola III and Christopher H. Carbine of Martzell, Bickford & Centola in New Orleans.
