Union alleges Premier Constructors Inc. did not pay contracted wage rates

Contract 04

BATON ROUGE – An Ascension Parish company is accused of not honoring a bargaining agreement.

Iron Workers District Council of Texas and the Mid-South States filed a complaint on Nov. 9 in the U.S. District Court for the Middle District of Louisiana against Premier Constructors Inc. alleging that the steel erector failed to comply with the Labor Management Relations Act (LMRA) regulations.

According to the complaint, the plaintiff alleges that it suffered damages for not receiving the agreed contractual wage rates. The plaintiff holds Premier Constructors Inc. responsible because the defendant allegedly refused to adhere to the terms and conditions of their collective bargaining agreement and failed to arbitrate plaintiff's grievance.

The plaintiff requests a trial by jury and seeks declaration that defendant violated the LMRA, enjoining defendant from refusing to arbitrate and ordering defendant to arbitrate with plaintiff's grievance, attorney's fees and all other equitable and injunctive relief. It is represented by Louis L. Robein of Robein, Urann, Spencer, Picard & Cangemi APLC in Metairie and Matt Bachop of Deats, Durst & Owen PLLC in Austin, Texas.
