Real estate company cites competitor for alleged trademark infringement

BATON ROUGE — A real estate company is suing Property One Realty Group LLC, a competitor, citing alleged trademark infringement and unfair competition.

Holding One, Inc. filed a complaint on Nov. 15, in the U.S. District Court for the Middle District of Louisiana against Property One Realty Group LLC alleging that the competitor willfully violated the Lanham Act.

According to the complaint, the plaintiff alleges that as a result of defendant's unlawful actions, it has suffered and will continue to suffer irreparable harm to its business and goodwill until a decision is rendered in its favor. The plaintiff holds Property One Realty Group LLC responsible because the defendant allegedly used of one or more of the plaintiff's "Property One" marks in its company name without authorization and refused to cease using the infringing Property One Realty Group LLC legal name.

The plaintiff requests a trial by jury and seeks an order permanently enjoining defendant from using the Property One marks and from engaging in any other activity constituting unfair competition with plaintiff. It is represented by M. Brent Hicks of McGlinchey Stafford PLLC in Baton Rouge.
