ALEXANDRIA – Two Lafayette Parish residents allege they were injured when the vehicle they were traveling in was struck by tire.
Davonas Handy and Tagaraick Handy filed a complaint on Nov. 16 in the U.S. District Court for the Western District of Louisiana against Southern County Mutual Insurance Co., Berrio's Transportation LLC and Clemente Quintanilla alleging negligence.
According to the complaint, the plaintiffs allege that on Nov. 27, 2015, they were guest passengers traveling in a 1999 Ford Expedition when suddenly and without warning, their vehicle was struck by a tire which had come off the truck and trailer owned and/or operated by defendants Berrio's and Quintanilla. They allege the incident caused them to sustain severe and disabling injuries that resulted in physical pain, mental anguish, lost wages and medical expenses.
The plaintiffs holds Southern County Mutual Insurance Co., Berrio's Transportation LLC and Quintanilla responsible because defendant Quintanilla allegedly failed to see what should have seen, failed to maintain control of his vehicle and operated the vehicle in a careless and reckless manner.
The plaintiffs request a trial by jury and seek compensation in an amount to be determined at trial, plus interest and all costs of these proceedings and such other relief as the law may provide.
