LAKE CHARLES – An insurance company has filed suit against a Bell City aviation company after a plane was damaged.
Avemco Insurance Co., as subrogee of David R. McFarland, filed a complaint on Nov. 18 in the U.S. District Court for the Western District of Louisiana, Lake Charles Division against Bruce A. Beard, Beard’s Aircraft Services and ABC insurance company alleging that defendants Beard and/or Beard’s Aircraft alleging negligence.
According to the complaint, on June 15, 2009, McFarland purchased a 1951 Cessna and that on Nov. 10, 2015, defendants Beard and/or Beard’s Aircraft installed an Electronics International CGR 30P engine monitor/analyzer to the Cesna. On Nov. 24, 2015, the suit states Beard was the pilot-in-charge of the aircraft when it crash landed and was rendered total loss. As a result, plaintiff paid damages and insurance benefits to McFarland in the amount of $130,000; $8,189.60 for recovery; $1,535 in storage costs and $1,000 for medical payments. The plaintiff holds Beard, Beard’s Aircraft Services and ABC insurance company responsible because Beard and Beard’s Aircraft allegedly negligently installed the CGR 30P engine monitor on the aircraft, negligently maintained and repaired its engine and negligently operated the aircraft.
The plaintiff requests a trial by jury and seeks compensation for all damages, costs of these proceedings and for all equitable relief that is reasonable. He is represented by Michael D. Ferachi and C. Kieffer Petree of McGlinchey Stafford PLLC in Baton Rouge.
