Gulf States Real Estate Service employee accused of negligence after Highway 22 crash

NEW ORLEANS – A trustee and motorist claim a St. Tammany Parish driver's negligence caused a collision and injuries.

Barbara Rivera-Fulton, in her capacity as the trustee of the bankruptcy estate of Penelope Marcel, and Penelope Marcel filed a complaint on Nov. 28 in the U.S. District Court for the Eastern District of Louisiana against Michael J. Saucier, Gulf States Real Estate Services of Louisiana LLC and Travelers Insurance Co. of America alleging negligence.

According to the complaint, the plaintiffs allege that on April 25, 2016, Marcel was operating her vehicle and was stopped near the corner of state Highway 22 and U.S. Highway 190 when she was struck in the rear by a vehicle being operated by Saucier, which was owned by Gulf States and insured by Travelers. The impact caused plaintiff's vehicle to collide with a third vehicle in front of her, the suit states. As a result, she alleges she sustained severe and disabling injuries.

The plaintiffs holds Saucier, Gulf States Real Estate Services of Louisiana LLC and Travelers Insurance Co. of America responsible because defendant Saucier allegedly failed to timely stop, failed to pay proper attention and failed to see what he should have seen.

The plaintiffs request a trial by jury and seek judgment in their favor in an amount sufficient to compensate their injuries, together with any and all further legal and equitable relief they may be entitled.
