Insurer claims Ouachita Parish man isn't cooperating with investigation of claim

BATON ROUGE – An insurer is seeking the court's help regarding an insurance claim made by an Ouachita Parish man.

AmTrust Insurance Co. of Kansas filed a complaint on Nov. 28 in the U.S. District Court for the Middle District of Louisiana against Jerry Jones seeking declaratory judgment.

According to the complaint, the defendant alleges that a result of an automobile accident that occurred on Dec. 3, 2015, he is retiring from his employment due to his health condition. On information and belief, the automobile liability insurance policy covering the tortfeasor is insufficient to cover his anticipated claims, the suit states. The plaintiff holds Jones responsible because the defendant allegedly refused to send any medical data or cooperate in the plaintiff's investigation on his attempts to adjust the pending claim.

The plaintiff requests a trial by jury and seeks declaration that defendant has a duty to cooperate with plaintiff, and that the court declare the extent of the duties and rights of plaintiff with respect to the claim and for all other equitable relief.
