NEW ORLEANS – A homeowner alleges his insurer failed to timely initiate a loss adjustment.
Scott Wolfe Jr. filed a suit against Scottsdale Insurance Co. in the Orleans Parish Civil District Court on Dec. 6.
According to the claim, the plaintiff purchased a home at 506 Nashville St. and purchased a builder's risk policy from the defendant for coverage in 2015 while he was performing renovations. The suit states that a storm caused damages to the home and that after asking the defendant for aid in gaining an estimate and received no contact from an adjuster, so the plaintiff contacted a company for an estimate. The suit claims that the defendant refused to compensate the plaintiff for the contingency fees and supervision costs.
The defendant is accused of breach of contract.
The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Donald A. Mau and others of the firm of Smiley Law Firm in New Orleans.
The case has been assigned to Division G Judge Robin M. Giarrusso.
