Law money 04

SHREVEPORT – A hand pump operator has filed a class-action lawsuit against his former frac water transfer employer over allegations he was not paid overtime wages.

Michael Yorba, individually and on behalf of others similarly situated, filed a complaint on Nov. 30 in the U.S. District Court for the Western District of Louisiana, Shreveport Division against Bulldog Oilfield Services Inc. and Brian K. Sneed alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for defendants within the last three years without receiving overtime compensation at a rate of time-and-one-half his regular rate of pay for hours worked over 40 in a workweek. The plaintiff holds Bulldog Oilfield Services Inc. and Sneed responsible because the defendants allegedly misclassified him as an exempt employee for FLSA overtime provisions and failed to properly pay him for those hours worked in excess of 40 within a week.

The plaintiff requests a trial by jury and seeks overtime compensation in the amount due to him, plus liquidated damages, attorneys’ fees, costs and expenses, prejudgment interest and any other relief the court deems just. He is represented by Ryan Goudelocke of Durio, McGoffin, Stagg & Ackermann in Lafayette.
