Mutual of Omaha Insurance accused of wrongfully denying coverage for home health services

NEW ORLEANS – An Orleans Parish resident alleges an insurance company wrongfully denied coverage.

Terry Barthe, as successor to the rights of Ruth Doescher Welker, filed a suit against Mutual of Omaha Insurance Co. in the Orleans Parish Civil District Court on Dec. 5.

According to the claim, the plaintiff hired home health care agency God's Sitting Angels to care for Welker and submitted a claim to the defendant for coverage. He alleges the defendant denied the coverage over claims the agency did not meet the criteria to be considered a home health care agency.

The defendant is accused of wrongfully denying coverage and for failing to provide a reasonable basis for denying benefits.

The plaintiff is seeking an unspecified amount in damages. The plaintiff is represented by Caleb H. Didricksen, Erin Bruce Saucier, Carl A. Woods III, Jeremy J. Pichon and Michael S. Finkelstein of Didriksen, Saucier, Woods & Pichon in New Orleans.

The case has been assigned to Division L Judge Kern A. Reese.
