Jet Concrete Services accused of not paying manual laborers overtime wages

Law money 08

NEW ORLEANS – A manual laborer has filed a class-action lawsuit against his former employer alleging he is owed unpaid overtime wages.

Fausto Alvarez, individually and on behalf of all other similarly situated persons filed a complaint on Nov. 30 in the U.S. District Court for the Eastern District of Louisiana against Jet Concrete Services LLC, Edward Keenan and Jason Rodgers alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that while he was working for the defendants from approximately February 2015 to December 2015, he was not paid overtime premium for each hour worked over 40 per workweek. The plaintiff holds Jet Concrete Services LLC, Keenan and Rodgers responsible because the defendants allegedly willfully violated the overtime provisions of the FLSA by not paying proper overtime compensation at the rate no less than one-and-a-half times his hourly rate for all hours worked in excess of 40 per week.

The plaintiff requests a trial by jury and seeks an order certifying this case as a collective action, award for all unpaid overtime wages due, plus liquidated damages, attorneys’ fees and costs and pre- and post-judgment interest and such other general relief. He is represented by Roberto Luis Costales and Emily A. Westermeier of The Costales Law Office in New Orleans and William H. Beaumont of Law Office of William H. Beaumont in New Orleans.
