Service technician accuses employers of unpaid wages

LAFAYETTE — A service technician is suing joint employers, alleging violation of workers compensation acts in failing to pay proper overtime.

Toran Wilson filed a lawsuit Dec. 2 in U.S. District Court for the Western District of Louisiana against Monster Heavy Haulers LLC, Deep Well Energy Services LLC and George Anthony Cook, alleging violation of the Fair Labor Standards Act.

According to the complaint, from January 2014 to June 2016, Wilson worked approximately 75 hours per week as a technician without receiving proper overtime compensation for all hours worked in excess of 40 per week. 

The plaintiff alleges the defendants mis-classified him as an exempt worker from overtime and failed to pay him one and one-half times his regular rate of pay for all hours worked over 40 per week as required by FLSA.

Wilson seeks trial by jury, judgment equal to unpaid back wages, liquidated damages, attorney fees and court costs and all other appropriate relief. He is represented by attorneys Amanda Hilgendorf and Gregory J. Miller of Miller, Hampton & Hilgendorf in Baton Rouge.
