Special events distributor accuses restaurant operator of satellite TV piracy

NEW ORLEANS — A California special events distributor is suing New Orleans restaurant operators, alleging satellite TV piracy.

J&J Sports Productions Inc. of Campbell, California, filed a lawsuit Dec. 4 in U.S. District Court for the Eastern District of Louisiana against Starzfood & Spirit LLC and Danielle Perry, alleging violation of the Cable & Television Consumer Protection and Competition Act.

According to the complaint, on Nov. 22, 2014, J&J Sports distributed and telecast nationwide the Manny Pacquiao v. Chris Algieri, WBO welterweight championship fight program that the defendants did not pay for. As a result of the defendants' unlawful actions, the suit says, the plaintiff suffered monetary damages. 

The plaintiff alleges the defendants unlawfully intercepted and exhibited J&J Sports' program without the plaintiff's permission and/or authorization.

J&J Sports Productions seeks trial by jury, statutory damages for each willful violation of $100,000 under 47 U.S.C. 605 (e)(3)(C)(ii), $10,000 under 47 U.S.C. 553 (c)(3)(A)(ii), and $50,000 under 47 U.S.C. 553 (c)(3)(B), plus attorney fees and costs of suit and all other proper relief. It is represented by attorney Ronnie J. Berthelot of The Berthelot Law Firm LLC in Baton Rouge.
