Construction company accuses bank of fraud

NEW ORLEANS – A construction company is suing a bank, alleging a work contract was breached and that the plaintiff was treated in a fraudulent manner.

Emiii Holdings LLC and Earl Myers Jr. filed a lawsuit Dec.16 against First NBC Bank, Terry Vinnet, Jason Picone, D'Andra Davis and XYZ Insurance Co, alleging conspiracy, fraud and misrepresentation.

According to the complaint, Emii Holdings was the owner of 2314-24 Rev. John Raphael Jr. Way and 2426-34 Simon Bolivar Ave. in New Orleans. The suit states Myers began construction for Vinnet, who was planning a subdivision in Jefferson Parish.

The lawsuit states the plaintiffs were charged with the construction of Picone's home and were told to open an account with First NBC Bank. Additionally, Vinnet told the plaintiff that the bank would set up a $650,000 line of credit to Davis for the construction of her home and a contract was executed, the suit says.

However, the suit states, the loan documents required by the contract were never provided the plaintiff. The suit charges the defendants with rescission of contract, fraud in the inducement and conspiracy.

Emil Holdings and Myers seek all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Ernest L. Jones of New Orleans.
