Family alleges construction repair business breached contract

NEW ORLEANS – A family is suing a construction business, alleging the defendant owes more than $100,000 for uncompleted work.

Albert L. Pulley Sr., Margaret Pulley Johnson and Albert L. Pulley Jr. filed a lawsuit Dec. 29 in Orleans Parish Civil District Court against Lawrence Mackie Jr., L. Mackie Construction Inc, and its successor-in-interest, alleging breach of contract.

According to the complaint, the plaintiffs signed a contract with Mackie Construction on April 10, 2010, for work on the Pulley property at 1801-03 Third St, New Orleans. The suit states that the total estimate for work was to be $67,900.

The lawsuit states the Pulleys created another contract with the defendant for completion of work at 12930 Ashland Drive, New Orleans, for $41,700. The suit alleges the defendant allegedly has failed to complete the job at either of the addresses, rendering the defendant indebted to the plaintiffs for $112,183.13 for uncompleted work.

The plaintiffs seek the money owed, all reasonable damages, court costs, attorney fees and all appropriate relief. They are represented by attorney Marc R. Michaud of Patrick Miller LLC in New Orleans.

The case has been assigned to Division B Judge Melvin Zeno.
