NEW ORLEANS – An electrical assembler for a Kenner plant alleges he was wrongfully terminated while on disability leave.
Rene' Paige filed a complaint on Dec. 26 in the U.S. District Court for the Eastern District of Louisiana against Pellerin Milnor Corp. alleging that the former employer violated the Americans with Disabilities Act and Title VII of the Civil Rights Act.
According to the complaint, the plaintiff is an African-American man and was diagnosed with chronic hypertrophic degenerative osteoarthritic disease in his foot in August 2015 as a result of standing on his feet for more than 10 hours per day. The suit states he was approved for short-term disability. The plaintiff alleges that on Jan. 11, 2016, he was terminated from his employment while he was still under his physician’s care on allegations from the defendant that he had misrepresented his medical condition.
The plaintiff holds Pellerin Milnor Corp. responsible because the defendant allegedly retaliated against him because of his disability and terminated his employment to stop any and all disability benefits in defendant's short-term disability plan. As a result of the defendant’s alleged reckless conduct, plaintiff claims suffered physical and mental pain, humiliation and loss of income.
The plaintiff requests a trial by jury and seeks compensatory, consequential and punitive damages, attorneys' fees and costs and any other relief that the court deems appropriate.
