GRETNA - A Harahan homeowner is suing the city, alleging raw sewage was pumped into her home.
Laurie L. Miller and Ann Louise Collins filed a suit Jan. 25 against Blue Flash Sewer Service Inc and the city of Harahan in the 24th Judicial District Court, alleging negligence.
According to the claim, plaintiff, Miller was owner of the property at 7716 Wilson St., Harahan, and Collins was in Miller's home Jan. 28, 2016. The suit states Collins noticed a gurgling sound and saw tsewage spraying up from the toilet and spraying her.
The lawsuit states Miller learned Blue Flash Sewer Service, was doing work that may have been causing the backflow of the toilet, and she called to have the action stop. Unfortunately, the lawsuit says, Blue Flash failed to take the necessary actions and the plaintiff's home continued to be flooded with sewage.
Miller, the suit says, also contacted the Harahan Fire Department to request aid but was turned away. Due to Miller's persistence, a city of Harahan representative came to the plaintiff's property and assured her the sewage would cease flowing into her home.
However, the suit says, the backflow continued from 11:30 a.m. to 3 p.m. The presence of raw sewage in the home required the plaintiffs to receive medical attention and they were emotionally and mentally harmed in the process, the suit says.
The defendants are accused of negligence through failing to cease the flooding, failing to take the necessary precautions to prevent such an incident from occurring and overall negligence and fault in the incident.
Miller and Collins seek all reasonable damages, attorney fees and court costs. The plaintiffs are is represented by attorney Michael A. Britt in Kenner.
