NEW ORLEANS – A Houston company is seeking a judgment that it is not infringing a Mandeville company's trademark.
Nationwide Signs LLC filed a complaint on Jan. 16 in the U.S. District Court for the Eastern District of Louisiana against National Signs LLC seeking declaratory judgment.
According to the complaint, the defendant claims it owns the rights, title and interest for the National Signs trademark and has asserted that the plaintiff is infringing its mark with its Nationwide Signs name. The plaintiff alleges that the defendant's trademark is generic and not entitled to any protection.
The plaintiff requests seeks declaration and judgment that defendant's trademark is invalid and void and unenforceable and that plaintiff has not at any time infringed the same, award for costs of this suit and such other just and proper relief.
