Man alleges Jayco trailer he purchased was defective

NEW ORLEANS – A consumer alleges a recreational trailer he purchased in Lacombe had defects and is seeking rescission of the purchase.

Lance Hooper filed a complaint on Jan. 16 in the U.S. District Court for the Eastern District of Louisiana against Jayco Inc. of Indiana and Steve's Mobile Home & R.V. Repair Inc. alleging that they violated the Magnuson-Moss Warranty Act and other counts.

According to the complaint, the plaintiff alleges that on Aug. 7, 2015, he purchased a 2016 Jayco N. Point from defendant Steve's Mobile Home for $61,637.50. When delivered, the trailer allegedly was defective in materials and workmanship and such defects substantially impaired its use, value and safety. The plaintiff holds Jayco Inc. of Indiana and Steve's Mobile Home & R.V. Repair Inc. responsible because the defendants allegedly failed to repair the vehicle in a good and workmanlike manner so as to bring it into conformity with the warranties and failed and refused to buy back the defective vehicle.

The plaintiff requests a trial by jury and seeks rescission and/or cancellation of the sales contract, revocation of acceptance, award for incidental and consequential damages, economic losses, costs of suit and all other appropriate relief.
