Smith Construction says property owners withheld important information prior to sale

NEW ORLEANS – A construction company in St. Tammany Parish claims that it was sold a restricted property.

Smith Construction Co. filed a lawsuit Feb. 1 against Alvin Jackson, St. Marks Community Center, Winters Title Agency Inc., Fidelity National Title Insurance Co. and Prime Imports Co. Inc. in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, Smith Construction sought to purchase a property from the defendants on July 13. The suit states that the company wanted to use the property for building and renovations; however, Smith Construction was made aware only after the purchase of the property that it was part of a resubdivision and could not be used for the purposes that the company had desired.

The defendants are accused of negligence and breach of contract through failing to disclose all important information to the plaintiff, failing to inform the company of the restrictions.

Smith Construction seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Wayne J. Jablonowski of Law Office of Wayne J. Jablonowski APLC in Slidell.

The case has been assigned to Division I Judge Piper D. Griffin.
