Seller misrepresented condition of Katrina-damaged home, complaint says

NEW ORLEANS — A trust is seeking damages for a defective home that it was sold.

Martin Living Trust, through trustees David J. Martin and Lorraine P. Martin, filed a lawsuit Jan. 27 against Cesar Roberto Burgos in Orleans Parish Civil District Court alleging breach of contract.

According to the complaint, the defendant sold the property of 87 East Park Place to the plaintiff for the price of $329,000. The suit states that the defendant misrepresented the condition of the property and failed to explain that it had been damaged during Hurricane Katrina. After the property had been purchased by the plaintiffs, it sustained flooding-related damages and the plaintiffs had to pay for the repairs.

The defendant is accused of breach of contract, misrepresentation and fraud for their actions.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Albert J. Nicaud of Nicaud & Sunseri Law Firm LLC in Metairie.

The case has been assigned to Division J Judge Paula A. Brown.
