Woman files suit against judge, clerk of court over allegations that she was deprived of her rights

BATON ROUGE – A Dubach woman alleges that members 20th Judicial District Court of East Feliciana Parish have disregarded the laws of the state and courts.

Erin McDonald filed a complaint on Feb. 24 in the U.S. District Court for the Middle District of Louisiana against Judge William Carmichael and Clerk of Court David Dart alleging she was deprived of her rights.

According to the complaint, the plaintiff alleges that after she won a supervisory writ of the 1st Circuit Court of Appeal that reversed the revocation of the pauper order, defendant Carmichael was ordered to conduct a hearing. The plaintiff holds Carmichael and Dart responsible because defendant Carmichael allegedly has repeatedly refused to hold a hearing and to acknowledge the current standing of the pauper order and Dart has allegedly not sent plaintiff a notice of estimated costs and refused to sign a pauper order.

As a result of defendants' alleged acts, plaintiff claims she has suffered and will continue to suffer irreparable harm until an injunction is issued by the court.

The plaintiff requests a trial by jury and seeks injunction order enjoining defendants from acting outside their official capacities, declaring that defendants actions' are deprivation of plaintiff's rights and retaining jurisdiction over this action to assure full compliance by defendants. She is representing herself.
