Claiborne Parish couple claims rights were violated after purchasing car

SHREVEPORT – A Claiborne Parish couple alleges they were falsely arrested after purchasing a vehicle.

Mariette Kimble Wilson and John L. Wilson filed a complaint on Feb. 27 in the U.S. District Court for the Western District of Louisiana, Shreveport Division against Brown Chrysler Dodge Jeep Ram LLC, Webster Parish Sheriff, Claiborne Parish Sheriff, et al. alleging that they violated the First, Fourth and 14th Amendments of the U.S. Constitution.

According to the complaint, the plaintiffs allege that on Feb. 15, 2016, they purchased a 2015 Dodge Charger from Brown Chrysler Dodge Jeep Ram. They allege they signed a contract, put $2,000 down and traded in their Impala. The suit states that Brown Chrysler Dodge Jeep Ram later asked Mariette Wilson to return the Charger because she allegedly failed a credit check and after the defendant drafted two payments from her account. Mariette Wilson refused to return the vehicle on the advice of counsel since she had signed a binding contract, the suit states.

The plaintiffs holds Brown Chrysler Dodge Jeep Ram LLC, Webster Parish Sheriff, Claiborne Parish Sheriff, et al responsible because the Brown Chrysler Dodge Jeep Ram made criminal complaints against the plaintiffs and they were arrested on March 1, 2016, for unauthorized use of a motor vehicle allegedly without probable cause. The suit states the charges were later dismissed.

The plaintiffs request a trial by jury and seek judgment against defendants, in solido in a reasonable amount to be set by the court, plus interest, compensatory, punitive and consequential damages, costs of court and such other and further relief. They are represented by Nelson W. Cameron in Shreveport.
