Consumers allege General Motors vehicle they purchased has defects

NEW ORLEANS – A Louisiana couple is seeking the rescission of a sales contract for a Chevrolet truck over allegations the truck is defective.

Dustin M. Smith and Sarah Smith filed a complaint on March 2 in the U.S. District Court for the Eastern District of Louisiana against General Motors LLC alleging that the car manufacturer violated the Louisiana Redhibition Law.

According to the complaint, the plaintiffs allege that on Jan. 17, 2015, they purchased a new 2014 Chevrolet Silverado from Red River Chevrolet for $50,000. When delivered, they allege the vehicle was defective in materials and workmanship and that the defects substantially impaired its use, value and safety. The plaintiffs hold General Motors LLC responsible because the defendant allegedly failed to repair the vehicle in a good and workmanlike manner through its authorized dealers so as to bring it into conformity with its warranties.

The plaintiffs request a trial by jury and seek the remedy of rescission of the sales contract and returning to their purchase price; award for incidental, consequential, and nonpecuniary damages; economic losses; litigation expenses; and all other relief the court deems appropriate.
