NEW ORLEANS – An insurer is seeking damages after contractors allegedly caused water damage at a policyholder's property.
Certain underwriters at Lloyd's London, who issued insurance coverage for Mark C. Ledet, filed a lawsuit March 9 against the Andrew W. Bursten and Vicki R. Rabin Living Trust, Fabianmartins Construction LLC and Carol Condominium Association Inc., in Orleans Parish Civil District Court, alleging negligence.
According to the complaint, the insurer issued a coverage plan for Ledet for property at 2100 St. Charles Ave. The suit states that the defendant completed some construction work on the property on March 9, 2016. The suit states that the defendant completed the work in an unsatisfactory manner, resulting in water leakage that damaged the property. The insurer has paid the plaintiff $27,011.67 and is seeking full reimbursement by the defendants for the damages caused
The defendant is accused of negligence in the completion of the job.
The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys R. Todd Musgrave, Brent J. Carbo of Musgrave, McLachlan & Penn LLC in New Orleans.
The case has been assigned to Division A Judge Tiffany Chase.
