Consumer alleges Ford F-250 truck is defective, seeks rescission of sales contract

NEW ORLEANS – A consumer claims a Ford truck he purchased has the "death wobble" vibration defect and has been out of service for more than 72 days.

Kristian Michael Tardo filed a complaint on March 14 in the U.S. District Court for the Eastern District of Louisiana against Ford Motor Co. alleging that the automobile manufacturer violated the Magnuson Moss Warranty Act.

According to the complaint, the plaintiff alleges that on Aug. 15, 2015, he purchased a new 2015 Ford F-250 for more than $100,000. When delivered, the F-250 was allegedly defective in materials and workmanship, such defects substantially impaired its use, value and safety. The plaintiff holds Ford Motor Co. responsible because the defendant allegedly failed to perform repair work in a good and workmanlike manner so as to bring it into conformity with the warranties.

The plaintiff requests a trial by jury and seeks rescission of the sales contract, return of the purchase price, incidental and consequential expenses, award for diminution in value, litigation expenses and all other relief the court deems appropriate.
