Woman alleges Life Insurance Co. of America wrongfully denied disability benefits

Insurance 07

NEW ORLEANS – A Slidell woman alleges she is disabled and that her insurer has denied her disability benefits.

Janice M. Prange filed a complaint on March 22 in the U.S. District Court for the Eastern District of Louisiana against Life Insurance Co. of North America alleging that the Pennsylvania insurer violated the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that as a result of defendant's denial to pay benefits due to her under the plan, she has suffered and is continuing to suffer economic losses. The plaintiff holds Life Insurance Co. of North America responsible because the defendant allegedly wrongfully terminated her disability benefits to which she is entitled under the terms of the disability policy and denied her life insurance waiver of premium claim.

The plaintiff requests a trial by jury and seeks payments for all benefits due to her, plus interest, costs of suit and all other relief as the facts and law may provide. She is represented by James F. Willeford and Reagan L. Toledano of Willeford & Toledano in New Orleans.
