Ochsner Extended Care Hospital of Kenner allegedly failed to give specialized mattress to quadriplegic patient

GRETNA – A woman claims that her medical condition was worsened through the negligence of a health

care provider.

Jeannette Dinapolis filed a lawsuit March 20 in the 24th Judicial District Court against Louisiana Extended Care Hospital of Kenner LLC d/ba/ Ochsner Extended Care Hospital of Kenner for alleged negligence.

According to the claim, the plaintiff, a resident of Jefferson Parish, is a quadriplegic who was transferred to the defendant's property for physical therapy on Sept. 16, 2013. The suit says a doctor ordered a specialty mattress for the plaintiff to help her with the ulcers she had developed, but the mattress was never received and the one that the plaintiff was left to use caused her injuries to worsen and limited her movement. The plaintiff also suffered from methicillin-resistant Staphylococcus aureus, a bacteria infection that is resistant to many antibiotics, and had to seek continued medical care at other medical facilities, resulting in added expense and trauma.

The defendant is accused of negligence for failing to provide the plaintiff with the medical care she needed, failing to see that she was being harmed due to its lack of action and overall negligence.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. She is represented by Frank A. Silvestri, Damien Savoie of Silvestri & Savoie LLC in Metairie. The case has been assigned to Division B Judge Cornelius E. Regan.

The 24th Judicial District Court case number 770156.
