BATON ROUGE – A Baton Rouge home decor company claims a St. Tammany Parish individual is using its marks and creating similar products.
Three Threads LLC filed a complaint on March 23 in the U.S. District Court for the Middle District of Louisiana against Samantha Lanier, doing business as Sam Lanier, Sam Lanier Designs and SugarCane Home, alleging copyright and trademark infringement.
According to the complaint, plaintiff is the lawful and registered owner of trademarks Forget the Pearl and Lovingly Made in Louisiana. The plaintiff alleges that defendant's activities caused injury to plaintiff's goodwill and reputation, loss of value and profits. The plaintiff holds Lanier responsible because the defendant allegedly intentionally created and sold and continues to create and sell substantially similar works to plaintiff's glassware without authorization or permit and refused to comply with plaintiff’s amicable demand to permanently cease and desist from further infringing plaintiff's works.
The plaintiff seeks all damages, attorneys’ fees, legal costs and such other and further relief as the court deems just and proper. It is represented by Charles A. Anzelmo, Marc S. Whitfield and L. Adam Thames of Taylor, Porter, Brooks & Phillips LLP in Baton Rouge.
