Woman claims she fell through roof at New Orleans home

NEW ORLEANS – A woman is seeking damages for falling through a roof.

Carly Elkin filed a lawsuit April 5 against Allen T. Bixby III in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff, a resident of Florida, was at the defendant's property at 2228 Broadway St., New Orleans. The suit states that the plaintiff was on the roof when the roof gave way, causing the plaintiff to fall and be injured.

The defendant is accused of negligence through failing to ensure the safety of the plaintiff and failing to ensure that the portion of the roof was sturdy.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney Scott E. Silbert of Silbert, Garon, Pitre & Friedman in New Orleans.

The case has been assigned to Division C Judge Sidney H. Cates IV.
