NEW ORLEANS – Two former laborer/gardeners for a landscaping company allege they are owed unpaid wages.
Arnol Castillo and Elvin Suazo Clark filed a complaint on April 13 in the U.S. District Court for the Eastern District of Louisiana against Fresh Cut Landscaping Inc., Brenda Newfield and Randy Carl Newfield alleging that they violated Fair Labor Standards Act and the Louisiana Wage Payment Act.
According to the complaint, the plaintiffs allege that they worked for more than 40 hours per week without receiving proper overtime compensation. The plaintiffs holds Fresh Cut Landscaping Inc., Brenda Newfield and Randy Carl Newfield responsible because the defendants allegedly failed to pay plaintiffs for their employment in excess of 40 hours per week at the rate of one-and-one-half times their regular rate and also made unjustified and unauthorized deductions from their wages.
The plaintiffs request a trial by jury and seek unpaid wages, liquidated damages and reasonable attorney's fees. They are represented by Clement P. Donelon and Michael R. Gelder of Leefe, Gibs, Sullivan & Duprè LLC in New Orleans.
