BATON ROUGE – A Kenner retail food store operator alleges its disqualification from accepting Supplemental Nutrition Assistance Program benefits was arbitrary and capricious.
Munay Discount LLC, doing business as Quick Save, filed a complaint on April 24 in the U.S. District Court for the Eastern District of Louisiana against United States of America seeking declaratory relief.
According to the complaint, the plaintiff alleges that on March 27, 2017, plaintiff was disqualified from participating in the Supplemental Nutrition Assistance Program for a period of six months due to alleged violations of Food and Nutrition Service regulations. The plaintiff holds United States of America responsible because the defendant allegedly failed to properly weigh evidence and argument presented in plaintiff's appeal.
The plaintiff seeks a request for the court to review the ginal agency determination and provide it with a trial de novo and invalidate plaintiff's disqualification from the SNAP program. It is represented by Cleveland R. Coon in Baton Rouge.
