Children, heirs accuse IRS of wrongful levy

SHREVEPORT – Estate representatives allege that a federal government agency wrongfully issued notice of a levy to collect income taxes allegedly owned by a deceased man.

Walter G. Goodrich, independent executor of the succession of Henry Goodrich, Henry Goodrich Jr., Laura Goodrich Watts and Walter G. Goodrich filed a complaint on May 5 in the U.S. District Court for the Western District of Louisiana, Shreveport Division against United States of America alleging that the government wrongfully levied taxes.

According to the complaint, Henry Goodrich Jr., Laura Goodrich Watts and Walter G. Goodrich are the children and heirs of Henry Goodrich and Tonia Gilreath Goodrich, both deceased. They allege that the IRS issued a notice of levy in April to collect tax purportedly due from Henry Goodrich. The plaintiffs hold United States of America responsible because the IRS allegedly failed to investigate the status of the property prior to a levy and that the levy incorrectly identifies the taxpayer.

The plaintiffs seek an order releasing and terminating the wrongful levy, attorney's fees and costs and all other relief that are necessary and proper. They are represented by Scott C. Sinclair of Sinclair Law Firm LLC in Shreveport.
