Orleans Parish woman claims she twisted her ankle on crumbling asphalt

NEW ORLEANS – An Orleans Parish woman is seeking damages after she allegedly twisted her ankle.

Dale Thomas-Mickle filed a lawsuit May 12 against Stirling Properties LLC, Magnolia Market Place LLC and Phoenix Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was at the defendant's property at 2900 S. Claiborne Ave., New Orleans on May 14, 2016, when the incident occurred. The suit states that the plaintiff was getting stepping off the curb when she twisted her ankle due to asphalt that was caving in.

The defendant is accused of negligence by failing to fix the situation or warn of the potential for injury.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney William G. Legrand in Metairie.

The case has been assigned to Division B Judge Rachael Johnson.
