NEW ORLEANS – A Covington man alleges that he was unlawfully detained by Ponchatoula police officers in Hammond.

Michael Smith filed a complaint on May 15 in the U.S. District Court for the Eastern District of Louisiana against the city of Hammond, Tommy Corkern, Matthew Brady, Corey Stewart and Lyle Newell alleging that the law enforcers violated the Fourth, Eighth and 14th Amendments to the U.S. Constitution.

According to the complaint, the plaintiff alleges that on June 22, 2016, he was detained for an extended period of time by the defendants. The plaintiff holds the city of Hammond, Corkern, Brady, Stewart and Newell responsible because the defendants allegedly subjected plaintiff to excessive use of force and cruel and unusual punishment, unreasonable search or seizure and deprivation of due process.

The plaintiff seeks damages in an amount deemed fair and equitable, award for litigation costs and attorney's fees. He is represented by the Rev. Charles E. Brumfield Jr. of Charles E. Brumfield Jr. Attorney at Law in Hammond.
