Premier South LLC alleges Mississippi company is unlawfully using trademarked name

BATON ROUGE – A Baton Rouge roofing company claims a Mississippi roofing company also doing business in Louisiana does not have authorization to do so.

Premier South LLC filed a complaint on May 17 in the U.S. District Court for the Middle District of Louisiana against Premier Roofing LLC and Donald Joel Boyte Jr. alleging trademark infringement, fraud and other counts.

According to the complaint, the plaintiff alleges that the defendants have misrepresented their business as Premier South with the intent to mislead customers. It also alleges the defendants have not obtained authorization from Louisiana to do business in the state.

The plaintiff holds Premier Roofing LLC and Boyte Jr. responsible because the defendants allegedly continued to do business under the name that is confusingly similar to plaintiff's name without plaintiff's consent and/or authorization.

The plaintiff requests a trial by jury and seeks damages of more than $100,000, attorney's fees and costs for the suit and all other relief as the court deems just and equitable. It is represented by Adam V. Vickers of Cara Stone LLP in New Orleans.
