Consumer alleges Equifax, others failed to remove dispute language from credit report

Late 07

LAFAYETTE – A consumer claims she was damaged because her credit report was not updated per her request.

Kellee Trahan filed a complaint on May 23 in the U.S. District Court for the Western District of Louisiana against Equifax Information Services LLC, TransUnion LLC, Lake Area Collections LLC, Afni Inc. and Transfinancial Cos. Inc. alleging that they violated the Fair Debt Collection Practices Act and the Fair Credit Reporting Act.

According to the complaint, the plaintiff alleges that she has suffered emotional and economic damages, loss of credit, undue stress and anxiety and was forced to refrain from applying for new credit. The plaintiff holds Equifax Information Services LLC, TransUnion LLC, Lake Area Collections LLC, Afni Inc. and Transfinancial Cos. Inc., responsible because the defendants allegedly failed to remove the dispute language in her credit files per request, which misrepresented the status of her alleged debts, and failed to conduct a proper investigation.

The plaintiff requests a trial by jury and seeks statutory, actual and punitive damages, costs, interest and attorneys’ fees. She is represented by Guy H. Leland of Guy H. Leland Law Office in Covington.
