Man claims that he was defamed by Toyota Motor Credit following car accident

NEW ORLEANS – A man claims that he was defamed after his insurance paid for a car accident he was involved in.

William Daniel Weidner III, individually and on behalf of Magnolia Fleet LLC, filed a lawsuit May 23 against Toyota Motor Credit Co. in Orleans Parish Civil District Court alleging defamation and infliction of emotional and financial distress, as well as loss of reputation.

According to the complaint, the plaintiff was involved in a car accident on July 27, 2015. The suit states that the plaintiff's car was insured through Progressive Insurance Company. Following the accident, the plaintiff's insurance company paid the defendant's damages in their entirety. The suit states that the defendant failed to clear the plaintiff's account, claiming that it had not been paid for the damages suffered. The suit states that the claims made by the defendant injured the plaintiff's reputation.

The defendant is accused of defamation and infliction of emotional and financial distress.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorney John D. Sileo in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
