Harrah's hotel guest claims she fell because of water on floor in room

NEW ORLEANS – A Livingston Parish woman claims she was injured when she slipped on a wet hotel floor in the middle of the night.

Sherri Smith filed a lawsuit June 5 against JCC Fulton Development LLC, doing business as Harrah's Hotel; Harrah's New Orleans Management Co.; Jazz Casino Co. LLC, doing business as Harrah's Hotel; Mergco Harrah's New Orleans Management Co. LLC; and ABC Insurance Co. in Orleans Parish Civil District Court alleging negligence.

According to the complaint, the plaintiff was a guest at the defendant's property at 228 Polydras St., New Orleans on June 16, 2016, when the incident occurred. The suit states that the plaintiff got out of bed and stepped onto the floor, which was covered in water. While trying to carefully walk through the water to get to the bathroom, the plaintiff slipped, fell and struck her body and head against the wall and floor.

The defendant is accused of negligence by failing to maintain the hotel, failing to warn of the danger and overall negligence in care toward guests.

The plaintiff seeks all reasonable damages, court costs, attorney fees and all appropriate relief. The plaintiff is represented by attorneys Leonard L. Levenson, Christian W. Helmke and Donna R. Barrios of the Law Office of Ammon L. Miller Jr. in New Orleans.

The case has been assigned to Division L Judge Kern A. Reese.
