NEW ORLEANS – A real estate business alleges that a New Orleans real estate agent is unlawfully using its mark.
GNO Real Estate Holdings LLC, doing business as NOLA Living Realty, filed a complaint on May 26 in the U.S. District Court for the Eastern District of Louisiana against Galiano Realty LLC, doing business as Nick Galiano Realty, and Nick Galiano alleging trademark infringement, unfair competition and other counts.
According to the complaint, plaintiff is the registered owner of the trade name NOLA Living Realty. The plaintiff holds Galiano Realty LLC and Galiano responsible because the defendants allegedly intentionally promoted and marketed their real estate services using the infringing NOLA Living Realty mark and the domain name nolalivingrealty.com. The plaintiff alleges that it has been damaged and that unless defendants are restrained by the court, plaintiff will continue to suffer serious irreparable injury.
The plaintiff seeks permanent injunction against continued infringement of the NOLA Living Realty Mark by defendants, award of damages, plus interest, costs, expenses and attorney fees in this action and all further relief as the court deems appropriate.
